JoyPix AI Terms of Service

This Service Agreement (hereinafter referred to as the "Agreement") is a legally binding agreement between you and JoyPix LLC (the operator of JoyPix.ai, hereinafter referred to as "we", "us", or "the Company") regarding your use of our generative AI platform and related services (collectively referred to as "the Services").

1. Service Overview

JoyPix.ai allows users to generate videos and other multimedia content ("Generated Content") based on uploaded or submitted materials (e.g., images, text, or other data, collectively referred to as "User Submissions").

2. Accounts and Compliance

You must be at least 18 years old to use the Service.

You are responsible for all activities under your account. We reserve the right to terminate accounts at any time for violations of this Agreement or local laws.

3. Content Ownership and Licensing

User Submissions: You retain ownership of your original materials.

Generated Content: Subject to your compliance with this Agreement and payment of applicable fees, you own the rights to the "Generated Content" produced using the Service.

4. Special License for Public Content

Our Service allows you to choose to make content public, such as publishing it to the "Explore" feed or other public display areas. If you choose to make content public:

• Global License: You grant JoyPix.ai a perpetual, non-exclusive, sublicensable, free, royalty-free, irrevocable, worldwide license.
• Rights to Use: We have the right to use, display, download, distribute, reproduce the aforementioned files or content (including but not limited to models, images, training data, etc.), or assets generated based on your instructions in any form in any current or future media (including but not limited to the internet, social platforms, advertising, or promotional materials), and the right to create derivative works based on such content.

5. User Conduct Guidelines

You agree not to use the Service to:

• Generate any illegal, pornographic, violent, hate speech, or content that invades the privacy of others.
• Create false or misleading deepfake content using another person's likeness or voice without their explicit permission.
• Infringe upon the copyright, trademark, or other intellectual property rights of any third party.
• Use automated scripts or any unnatural means to abuse system computing resources.

6. Subscription, Billing, and Refunds

Specific prices for the Service are subject to the display on the order page.

Refund Policy: Given the high GPU computing costs involved in AI generation services, refunds are generally not provided unless there is an irreparable technical failure of the Service.

7. Disclaimer and Limitation of Liability

• Provided "As Is": The Service is provided on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or suitability for a particular purpose of the generated results.
• Liability Cap: To the maximum extent permitted by applicable law, JoyPix.ai shall not be liable for any indirect, incidental, or punitive damages. Our total liability to you shall not exceed the fees you paid to us in the past 12 months.

8. Termination and Cancellation

We may, based on reasonable judgment, suspend or terminate your access to the Service in situations such as your violation of these Terms or applicable laws, security or fraud risks, receipt of valid complaints, or requirements from competent authorities; to the extent permitted by applicable law, except for our willful misconduct or gross negligence, we shall not be liable for any indirect losses resulting therefrom.

9. Dispute Resolution and Jurisdiction

• Applicable Law: This Agreement shall be governed by the laws of the company's place of registration, without regard to its conflict of law principles.
• Dispute Resolution: Any dispute arising from this Agreement shall first be attempted to be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the court with jurisdiction where the Company is located.

10. Modifications to Terms

We reserve the right to modify or replace these Terms at our sole discretion. For material changes (such as adjustments to the scope of personal information collection, purpose of use, or sharing methods), we will notify you 30 days in advance via website announcement, email, or internal message. Continued use of the Service constitutes your agreement to the modified policy.

11. Prohibited Content and Conduct (Critical Update)

11.1 Strict Prohibition of Adult Content

Users are strictly prohibited from using JoyPix services to generate, upload, process, or distribute any form of "Adult Content." This includes, but is not limited to:

• (a) Sexually explicit material, pornography, or erotic content;
• (b) Non-consensual sexual imagery (commonly referred to as "Deepfakes");
• (c) Content that violates the "High-Risk Merchant" standards or compliance rules set forth by major Card Networks (including but not limited to Visa and Mastercard).

11.2 Zero-Tolerance Policy

JoyPix maintains a zero-tolerance policy regarding the breach of Section 11.1. Any user found in violation will face immediate and permanent account termination, forfeiture of all remaining credits, and a permanent ban from the platform without any right to a refund.

12. Indemnification and Liability for Fines

12.1 User Liability for Network Fines

The User acknowledges that any violation of the Content Policy (Section 11.1) may result in significant financial penalties imposed on JoyPix by third-party payment processors or global Card Networks (e.g., Mastercard’s Global Merchant Audit Program).

12.2 Indemnification

User agrees to fully indemnify, defend, and hold JoyPix harmless from and against any and all fines, penalties, legal fees, and operational costs incurred as a direct or indirect result of the User’s non-compliant content. JoyPix reserves the right to pursue full legal and financial recovery against the User to the maximum extent permitted by law for any such fines (including but not limited to penalties up to or exceeding US$50,000 per incident).
